"I voted in favour of the one amendment tabled to this report, thereby rejecting the Council position on the text.
This file is part of the ‘Market Pillar’ of the Fourth Railway Package, which I oppose as it is aimed at entrenching full liberalisation of the European railway sector.
This file concerns a Council recommendation for the repeal of Regulation 1192/69, which currently allows Member States to compensate railway companies for payments they are obliged to make but other transport modes are not. These obligations include special payments for accidents at work, pensions for early retirement of workers in arduous jobs, and for costs relating to level crossing facilities.
The Regulation was adopted when rail services and infrastructure were integrated and were closely related to national governments. It contains a list of (now largely formerly) state-owned railway companies, who are entitled to receive the compensation mentioned, while any companies not listed are not entitled to compensation.
The Commission considers this Regulation discriminatory, and rather than suggesting the list be updated, recommends its repeal. This is the same position as the Council. Since 2007 Ireland and 3 other countries have regularly made use of this Regulation. Therefore I voted in favour of the amendment to reject the Council’s position."@en1
