"I voted in favour of the referral of CETA to the European Court of Justice because I believe that this agreement raises important legal questions that must receive proper answers before MEPs can vote on it. CETA would be the first ever EU trade deal to include an investment dispute arbitration mechanism. This mechanism, known as the Investment Court System (ICS), would become the template for investment protection in all future trade deals. Yet it has never been tested. A large number of respected legal experts, trade unions and consumer organisations have argued that ICS could seriously hamper the UK government’s ability to regulate in the public interest. It could also infringe on EU and national courts’ jurisdictions, and give foreign investors greater rights than European investors. These questions are too important to be overlooked, and it is therefore entirely appropriate for MEPs to seek the opinion of the European Court of Justice on these matters."@en1
