"This non-legislative report was initiated following the EP resolution on the situation in Hungary on 10 June 2015 that had called for a Commission proposal on the establishment of an EU mechanism on democracy, the rule of law and fundamental rights, as a tool for compliance with and enforcement of the Charter and Treaties as signed by all Member States.
The origin of this proposal is to tackle the limitations (or inoperability) of the current rule of law mechanism, mainly Article 7 TEU. This report recommends, until a possible Treaty change, that the Commission by September 2017 submit a proposal for the conclusion of an EU Pact for Democracy, the Rule of Law and Fundamental Rights (DRF). It will take the form of an interinstitutional agreement. The report also suggests that the ECJ should monitor legislation from Member States when the ECJ’s remit is to examine adherence to EU law in relation to the Treaties.
While I strongly support the promotion of fundamental rights in the EU, I am opposed to such a significant transfer of powers away from Member States towards the Commission, which is why I voted against the report."@en1
