"I voted against this report on the grounds that it amounts to a transfer of justice powers away from Member States and to the Commission.
The underlying concern behind this Commission proposal is an assumption that different customs sanctions regimes in the 28 Member States create distortions and, in particular, encourage importers to operate in those Member States with the lowest penalties. This concern is shared by some WTO members, who claim there can be no customs union without a unified sanctions system. The Council stalled the proposal which was presented by the Commission two years ago.
The Committee on the Internal Market amended the Commission proposal on several points, the key one being that the Commission proposal tried to harmonise both administrative and criminal sanctions, while Parliament only proposes administrative sanctions and leaves criminal sanctions subject to national legislation. However, the text also determines how judges should calculate the fines, leaving no judicial discretion. The effects of this proposal on national criminal systems are not sufficiently investigated, but are likely to be significant. As I believe justice powers must remain as a competence of the Member States, I voted against the overall report."@en1
