"We can all agree that the right to a fair, independent and impartial trial is the cornerstone of an effective judicial system and just society. Those charged with offences have the right to be presumed innocent until proven guilty and this is essential to ensuring that the public have confidence in our courts and democratic processes as a whole. In this sense, I support the premise that those detained under a European Arrest Warrant should have an entitlement to legal representation, and that this eligibility should be subject to the same tests applied at a national level for the same offence. In Northern Ireland, we have increasingly seen legal aid used under the auspices of human rights law by those liable for terrorist atrocities in an effort to evade the rulings of national courts in the United Kingdom. Only last week the ECHR rejected appeals by two republican terrorists liable for the Omagh Bombing in 1998 which killed 28 people. Whilst ensuring free and fair access to legal representation is vital, provision must also be centred toward addressing the needs of innocent victims and ensuring that the balance of protections do not tip toward the perpetrator."@en1
