Considering that Mr. Ujhelyi made the defamatory states at a time when he was not a Member of the European Parliament, it must be noted that when making the statements in question, István Ujhelyi was not acting in the performance of his duties as Member of the European Parliament. The fact that under national Hungarian legislation candidates standing in elections to the national parliament or to the European Parliament may enjoy parliamentary immunity in accordance with national procedures does not alter this conclusion for the purposes of the procedure in the European Parliament."@en1
