Notionally Article 5 TEU is supposed to invite consideration of whether an EU competence is necessary or whether the proposed action could properly and effectively be carried out at Member State level. The unelected European Commission has no desire to allow Member States any say in the subsidiarity and proportionality of new laws. The power-hungry bureaucrats have only one desire, to see national parliaments’ independence sacrificed into that of a superstate."@en1
