"The Agreement introduces a preferential trade regime – the Deep and Comprehensive Free Trade Area (DCFTA). The European Union is Moldova’s largest trading partner, while imports from Moldova increased by 20% following the entry into force of the DCFTA. The agreement includes a bilateral safeguard clause in Articles 165 to 169. This clause protects the Union’s industry against an excess of imported goods which could cause ‘serious injury’ to industry. This may result in the suspension of a further reduction in the rate of customs duty on the concerned product. Article 148 of the agreement allows for an ‘anti-circumvention mechanism’. This enables the reintroduction of the ‘most-favoured-nation’ customs duty rate when imports from Moldova are in excess of a certain threshold without justification of their origin. This clause is crucial to avoid the Union importing non-Moldovan products via Moldova. Safeguard measures and anti-circumvention mechanism cannot be applied in unison to the same product."@en1
