"Mr Iwaszkiewicz is accused of an offence under Article 92a of the Polish Code of Administrative Offences in conjunction with Article 20(1) of the Polish Road Traffic Act of 20 June 1997. This case falls under Article 9 of Protocol (No 7) on the Privileges and Immunities of the European Union. This provides that Members, in the territory of their own state, are protected with the same immunities accorded to Members of the Parliament of that State. It is for the European Parliament to decide whether criminal proceedings against Mr Iwaszkiewicz are authorised. Immunity will generally be waived if the offence is within the remit of Article 9 of Protocol No 7, once there is no .
