"Mr President, when two patents were granted by the European Patent Office on broccoli and tomatoes in March, the implications of those decisions in the long term were enormous. Over 300 applications for patents on plant material are currently awaiting decision by the European Patent Office. One patent has already led to claims of 900 varieties.
European legislation is currently based on plant breeders’ rights, as has been said, and does not allow for patents in plant varieties. Essentially, it is a biological process. However, through claims on the products obtained from those two processes, varieties are in practice being patented. Patents granted for plant traits and varieties obtained through biological processes set a dangerous precedent. We need clarity from the Commission on this issue. Plant breeders need to be able to equip themselves better for the future, and I have to say, Commissioner, you were less than persuasive in your opening remarks. I hope you do better when you wind up."@en1
