"Madam President, this judgment is controversial and it has created a significant, burdensome and costly legal vacuum. Ironically enough, whilst the aim of this decision was to uphold individual privacy rights, it has made these rights more vague and more uncertain than ever. We must not make it more difficult for businesses to operate or more difficult to protect the data of individuals. Potentially we have opened the door to a patchwork of decision making across the EU. We repeatedly find ourselves in a situation where courts are determining policy before we legislate, and this has to stop. We now need to find fast, quality and effective solutions for commercial activity in data protection, which should not be overshadowed by any discussions relating to the activities of the intelligence community. This judgment certainly must not affect the need for a positive and forward-looking agenda regarding data and trade with the United States, and the EU and the US need to keep cool heads. The Commission needs to come forward with a clear and immediate plan for interim transfers and to make sure that it delivers a better and stronger Safe Harbour agreement as soon as possible."@en1
