"While I appreciate that intellectual creations need protection if creativity and innovation are to flourish, and this is the role of intellectual property rights (IPR), the impact that such has on developing countries cannot be disregarded.
The report stipulated that market access for developing countries is only provided on the condition of a developed IPR system that is functioning well. However, this is often an impossible threshold for developing countries to meet. The need for an equitable and even balance between the interests of the IP right holders and public interests relating to access to knowledge, natural resources and health has not been addressed in any satisfactory manner. Furthermore, the creation of an extra EU organ in the form of an Observatory for IPR is something which I reject. I would rather see the use of already existing mechanisms.
For developing countries, a pragmatic and flexible approach is required in order to assist them in maximising the potential of their own intellectual assets and further their integration into international trade, while achieving broader societal welfare. It was for these reasons that I voted against this report."@en1
