"I could not support the final text agreed by Parliament and Council negotiators on the enforcement on the posting of workers directive. While progress was made in some areas, such as on improving cooperation between national authorities and on the cross-border enforcement of fines and penalties, I was disappointed that the Council was not willing to meet Parliament half-way on other key issues, namely Article[nbsp ]3, on the prevention of abuse and circumvention, Article[nbsp ]9, on effective national control measures, and Article[nbsp ]12, on ensuring joint and several liability in subcontracting chains. I believe the proposed enforcement directive could have and should have been used to address the genuine legal uncertainties opened by the ECJ’s Laval and related rulings. We still need a fundamental overhaul of the Posting of Workers Directive in order to better protect workers posted to another country and also to ensure legal certainty for businesses that wish to provide services across Europe. That remains a key challenge for the next Commission and European Parliament."@en1
