"I voted against the introduction of an optional contract law regime which is bad for the single market, bad for business and bad for consumers. The European Commission has consistently failed to provide any evidence that contract law has placed insurmountable barriers to cross-border consumer trade. If evidence demonstrated this to be the case, then a response from the Commission would be understandable. However, the introduction of a Common European Sales Law is not a solution to the legal difficulties encountered by consumers. If anything, the Commission’s proposals exacerbate problems by adding complexity to the scope and application of CESL. The proposals are bad for the single market, as they would cause confusion by offering alternative and competing legal frameworks. They are bad for consumers as they give the upper hand to businesses to choose which regulatory frameworks should apply. Finally, they are bad for business, as they add massively to costs by setting up a completely new alternative legal regime and requiring the close involvement of translators, international lawyers and judges. Completion of the Single Market will not be advanced by an instrument that splits and fragments national and cross-border consumer protection, and as such I cannot support this proposal."@en1
