"Madam President, current legislation in this area from 1989 no longer reflects the increased complexity of pricing and reimbursement procedures in Europe. Of course there is a difficult balance between Member States’ right to organise their public health systems, the need for a sustainable pharmaceutical sector and the interests of patients. I believe we must respect and defend national health authorities’ right to organise their own health systems, understand the diversity in European health systems and recognise the current difficult economic context. I do not believe the EU should be facilitating the pharmaceutical industry if this comes at the expense of good public health procedures and sustainable public health budgets.
Thankfully, many concerns we had on the proposal have now been removed or addressed in a substantial way. Firstly, contrary to its title, the proposal failed to make transparent the real prices paid across the EU, or which patients are getting access to which medicines. Without knowing what others are paying, Member States are not empowered to negotiate for the lowest price. Informed price negotiation can be an effective way to control expenditure. That is why I am happy that the committee vote reinstated the legal basis for the EURIPID database. This is not a public database, but it is used by over 20 Member States themselves to aid their decision-making on medicine pricing.
Another main issue was the unrealistic time limits on pricing and reimbursement. In the committee vote we have reversed this reduction for originator medicines and doubled the proposed generic time limits. This is a major improvement on the Commission proposal. The proposal for sanctions and penalties on Member States for missing the time limits has been removed. We also voted for a stop-the-clock process which triggers negotiations if the Member States request more information from the company. Again, this is a major improvement on the Commission proposal.
