The Commission’s proposal, on which this report gives an opinion, proposes amendments to and a recast of the current Regulation (EC) No 44/2001, in order to remove some parts which it considers would present ‘obstacles to the free movement of judicial decisions in line with the principle of mutual recognition’. It therefore proposes abolishing the
procedure, that is, the rapporteur agrees with the European Commission in supporting the view that a judgment given by a court in one Member State must compulsorily be recognised by another Member State without recourse to any other expedient. This new procedure constitutes another step towards the harmonisation of legislative procedures, which goes against independent, national and sovereign judicial powers; that is why we did not support this report."@en1
