"The Zwiefka report on the recast of the Regulation on the recognition of judgments in civil and commercial matters is a courageous and admirable step forward with respect to the Commission proposal. The premise is that judicial cooperation between the Member States is a necessary prerequisite for promoting the internal market. It is impossible to maintain a common European area without coherence between the exercise of a right and its protection. Parliament’s proposal to overcome the obstacle, expensive in terms of both money and time, of the enforcement procedure required to enforce in one Member State a judgment given in another Member State represents a significant act of responsibility in European integration, that has been executed with great competence and without overlooking respect for fundamental safeguards. The report proposes the abolition of
while maintaining control of respect for the right to adversarial proceedings, the principle of the formal final judgment and the fundamental values of the legal system in which the judgment is to be enforced. The path shown by Mr Zwiefka is the right way to go, and for this reason I voted in favour."@en1
