"Mr President, Commissioner, ladies and gentlemen, I too would like to draw your attention to the case of Aurore Martin, the French citizen arrested in Spain and handed over to the Spanish authorities who is serving a 12-year prison sentence. Her crime consists in having participated in Spain in meetings of the Batasuna party, a party that is illegal in Spain but legal in France where it even has some elected representatives. She is the subject of a European arrest warrant that has been enforced.
Although the establishment of the European arrest warrant in 2004 was greeted as the first step towards a European area of security and justice, today there are differences in its implementation that create inequalities between citizens of the European Union, and that is contrary to the very spirit of the framework decision establishing the European arrest warrant.
Moreover, where there are important political implications, as in the case of this Basque activist, shouldn’t the European arrest warrant include broader exceptions and not be issued automatically so as to provide a better guarantee of fundamental rights, including the freedom of expression, which has been prejudiced in the case of Aurore Martin?"@en1
