The principles governing tissue and cell donation are set out in Article 12 of Directive 2004/23/EC: ‘Member States shall endeavour to ensure voluntary and unpaid donations of tissues and cells. Donors may receive compensation, which is strictly limited to making good the expenses and inconveniences related to the donation. In that case, Member States define the conditions under which compensation may be granted’. Donated tissues and cells, such as skin, bones, tendons, corneas and haematopoietic stem cells, are increasingly used in medical therapies and as starting material for advanced therapy medicinal products. In addition, reproductive cells are used in the field of medically assisted reproductive technology, e.g. in vitro fertilisation. The most controversial issue concerned cord blood donations into private cord blood banks. We wanted to introduce critical wording about private cord banks for potential autologous treatment, as the Charter of Fundamental Rights prohibits making the human body and its parts a source of financial gain, yet private cord blood banks clearly have a commercial interest. We did not succeed in that, but managed to avoid any explicit promotion of private cord blood banks. We also managed to get rid of statements which tried to state that benefits in kind would not necessarily violate the principle of altruism."@en1
