"I agree that the justice system is the only mechanism that should issue judgments with regard to people, whether common criminals, war criminals or soldiers on the battlefield. However, what I suggest is that we note that the ordinary criminal procedure is highly flawed when used to fight a phenomenon such as an ‘international terrorist network’, which resembles a dispersed, asymmetrical army. I think that the Geneva Conventions, written 60 years ago, also fail to address this challenge fully, and it is a humanitarian challenge which is definitely not fully addressed by criminal procedures in our Member States."@en1
