"No one can deny the need for an international agreement, binding the maximum number of countries to respect the right to intellectual property. The EU is a global leader in the field of innovations, patents and scientific development. For our continent lacking in natural resources, the successful protection of this type of property is crucially important to the prosperity of all Europeans. Nevertheless, I will vote without hesitation against ACTA because the agreement has failed on the key point – to resolve the conflict between the protection of intellectual property and civil liberties. This is the main underlying reason giving rise to the outburst of unprecedented civil discontent. The numerous discussions pinpointed exactly the controversial areas creating an opportunity for abuses. It is sufficient for us to mention two of them. Firstly, the lack of a precise definition of the key term ‘commercial scale’ as grounds for prosecution and, secondly, the possibility of Internet service providers being forced to monitor their customers’ behaviour. This danger has been explicitly confirmed by the European Data Protection Supervisor. These are two clear examples of ACTA’s failure. I firmly believe that every time Parliament is faced with such a conflict, it will always side with fundamental rights and freedoms. In fact, this will happen by a huge majority, just as I expect tomorrow in this Chamber, which I will be joining."@en1
