"Mr President, we support the battle in tackling the trade in counterfeit goods, but this should not be waged at the risk of flouting European citizens’ fundamental rights. This is why we cannot support ACTA in its current form. We are particularly concerned about the provisions in Article 27, which states under point 4 that the competent authorities may have the authority to request an online service provider to disclose expeditiously to a rights holder information sufficient to identify a subscriber whose account was allegedly – and I stress here: allegedly – used for infringement.
There is also Article 14(2), which stipulates that a party may exclude from the application of the agreement small quantities of goods of a non-commercial nature contained in passengers’ personal luggage, which means that it can also decide not to exclude quantities of these goods, thereby raising deep concerns about the possible infringements of the free movement of goods and persons within the European Union."@en1
