"I voted for the report by Mr Creutzmann on customs protection of intellectual property rights (IPR), as I agree that protecting these rights in external trade relations is vital to the European economy, the competitiveness of which is based on innovation and the differentiation guaranteed by trademarks, patents, copyright and designations of geographical origin. In the first instance, it falls to the EU’s customs authorities to prevent pirated or counterfeit products from entering the internal market. I also agree that goods in transit should not be excluded from customs control, at least in cases where it may be suspected that these are intended for the internal market. Furthermore, I believe that it makes no sense to prevent the EU from seizing goods which infringe intellectual property rights that are protected within the EU, such as European trademarks, simply because they are intended for other markets, as no less damage is caused to the European companies that hold those rights. The case of generic medicines in transit to developing countries, under the relevant derogation clause of the World Trade Organisation’s intellectual property (TRIPS) agreement, is not at issue here because there is no infringement of the IPR of European pharmaceutical companies."@en1
