I regard Switzerland’s decision as discriminatory and unlawful. There is no basis in law for the re-introduction of limits on the number of long-term residence permits granted to EU citizens who hold citizenship of one of the eight Member States which joined the EU in 2004, and this would constitute a restriction on the free movement of persons as provided for under the 1999 agreement with the EU. Article 10 of the 1999 agreement, which contains the safeguard clause to which the Swiss authorities have referred, does not provide for any differentiation on the basis of citizenship. The Swiss authorities should immediately refrain from applying this safeguard clause."@en1
