"The Lisbon Treaty and the abandoning of the pillar structure simplified the path to the development of EU criminal law in the context of the EU as an area of freedom, security and justice. The report highlights the principles of criminal law (principle of individual guilt, legal certainty, non retroactivity and presumption of innocence). Moreover, judicial cooperation in criminal law is based on the principle of mutual recognition. To fully apply this principle, some flanking measures are needed to develop and legitimise ‘mutual trust’ – within an EU common criminal legal culture. Among these measures are harmonisation of substantive criminal law (crimes and sanctions) and common uniform minimum standards of protection for suspects and defendants in criminal proceedings and therefore, this report has to be supported, which I did by my vote in favour."@en1
