"I voted to amend the regulation on protection against dumped imports from countries not members of the European Community, given that Article 9.5 of the Basic Anti-Dumping Regulation is inconsistent with Articles 6.10, 9.2 and 18.4 of the World Trade Organisation (WTO) Anti-Dumping Agreement and with Article 16.4 of the WTO Agreement. I welcome the amendment since the proposal complies with the Treaty on the Functioning of the European Union and respects the principle of proportionality. The WTO agreements do not contain any legal basis for supporting the provisions of Article 9.5. Exporting producers in non-market economy countries should not be forced to demonstrate that they meet certain criteria in order to be able to receive individual treatment. However, certain special situations need to be taken into account when determining the degree of compatibility with the articles in order to impose a dumping margin and a single anti-dumping duty. This means that, although exporters are separate entities in legal terms, sometimes they must be treated as a single entity."@en1
