"Firstly, I would like to note that the Agreement between the European Union and the United States on Passenger Name Records does not measure up to the guarantees the European Parliament has demanded in its previous resolutions. The agreement that is to be concluded creates a basis for the disproportionate and unjustified gathering and storage of data. There is also no guarantee that the data will be used only for the purpose of reducing and preventing terrorism and international crimes. Unfortunately the decision adopted today infringes the foundations of democracy, more precisely people’s fundamental rights. This agreement does not guarantee the protection of personal data or individuals’ right to privacy and legal protection. The Commission has failed to improve the 2007 agreement in any way. Profiles continue to be prepared about completely unsuspicious passengers, they are classified into opaque risk categories and their data are stored for 15 years. After that the data are ‘fully anonymised’ instead of being deleted. This causes genuine concern as to whether the agreement is in compliance with the Charter of Fundamental Rights of the European Union and the legal precedents of the European Court of Human Rights and the Federal Constitutional Court of Germany. For that reason, I voted against this report."@en1
