"In the context of discussions concerning the shape of the agreement between the USA and the EU on the use of passenger flight data and the provision of such data to the USA Department of Homeland Security, I would like to draw attention to the possible consequences of its rejection or adoption.
In the first scenario the flow of personal data would not be interrupted at all. Controls over this process could only be established by way of an agreement. In addition, one should take into account the difficulties facing EU citizens and companies if, for example, there were no direct flights from a particular European city to the United States. On the other hand, the adoption of the agreement, with all its limitations, would be a definite step forward compared to the 2007 agreements, since there would be a more clearly defined range of data provided, more restrictions on the time this information is kept, access to information and more rigorous rules concerning the way the data is used. In summary, I would suggest adopting the agreement in its present form as a starting point for further work and negotiations to bring about essential improvements to the provisions of the agreement."@en1
