"In principle, the EU has strengthened the rights of travellers in recent years. Although corresponding arrangements for airline passengers already exist, the question of whether airlines have to offer general compensation to their passengers in the event of major delays is still the subject of dispute. A landmark ruling by the European Court of Justice is also pending in this regard. Airlines are refusing to pay financial compensation if ‘exceptional circumstances’ arise, referring to an obligation under international law whereby they may be required to provide their passengers with hotel accommodation and food in the event of a delay, but not compensation. Also in dispute is the question of whether an airline has to compensate passengers if they miss their connecting flight due to a delay. It is therefore important that the EU should deal with this issue again, although a number of issues nevertheless remain unresolved, such as the rigorous security provisions.
