The purpose of this proposal for a regulation is to prevent legal conflicts and long court cases for heirs, where the legal systems of more than one Member State are applicable. One of the new measures is the creation of a European Certificate of Succession, designed to clarify the legal position of the testator, and to safeguard the rights of heirs and other parties, including creditors.
