"I voted in favour of the report by Mr Lechner, which has the merit of clarifying the situation on succession law and thereby ensuring legal certainty. Indeed, European law is characterised by the combination of the laws of individual States, which creates inconsistent and difficult situations when it comes to recognising citizens’ rights. The creation of a European Certificate of Succession will act, on a cross-border basis, as proof of entries in registers and as a safeguard for persons acquiring succession property in good faith. For citizens habitually resident in their home country, if all their assets are there, nothing will change. Instead, the change affects those citizens who intend to reside, or are already resident, outside their home country: in this case, they will have the right to choose to adopt the law of their home country. Handling cross-border successions will therefore be made considerably easier and advisers on succession will also be given a secure basis on which to operate."@en1
