"The basic idea behind the Convention on Mutual Assistance in Criminal Matters of 2000 and the Protocol thereto is to enable, on the one hand, Member States to take measures within the framework of criminal proceedings in relation to persons residing in other Members States, and, on the other hand, to enable these persons to participate actively in proceedings in order to protect their interests or exercise their rights. These acts are therefore an important element in shaping the area of freedom, security and justice. The Convention and the Protocol set out the legal framework within which the relevant authorities of Member States conducting proceedings may operate, and stipulate procedural conditions and prerequisites for their adoption. These tools increase the effectiveness of procedures for holding people responsible for breaking the law and, as a consequence, provide a better guarantee of the rule of law and protect the interests of people in the area covered by the regulations. At the same time, they facilitate the realisation of the right to a trial. Extending their effectiveness to all Member States and to countries which have close ties with the EU, as well as to candidate countries, is a natural consequence of accepting the common ideas of freedom, security and justice. The agreement is another formal step toward the realisation of such ideas. Its validity is not in question."@en1
