"I welcome the Lechner report as it will help to establish further clarity and legal certainty for both the testator as well as for his heirs on his demise. With an estimated 12.3 million Europeans living in another EU country and 450 000 international successions per year which are in total valued at more than EUR 120 billion, it makes sense for the implications linked to cross-border successions to be discussed and even tackled at EU level. Nevertheless, the public policy aspects and principal national traditions in the field of succession distinct to each Member State should be respected, and should neither be encroached upon nor undermined by this Commission proposal. The fact that certain Member States have utilised the opt-out clause sends a strong message that certain countries disagree with elements of this proposal. This should be addressed and resolved – the main objective of this regulation is to eliminate or at least minimise the fragmentation which is currently prevalent in the field of succession at EU level and not to construct further barriers between Member States."@en1
