"Terrorism is one of the major challenges facing the modern rule of law, having clearly broken with the ‘classical’ paradigm of sovereignty. With the terrorist attacks of 2001, it became clear that there are global threats, or at least transnational threats, that can only be tackled in conjunction with others. It is on this basis that we must endeavour to understand this phenomenon. The EU Member States should devise a joint policy that will enable them to confront this problem effectively without sacrificing their fundamental axiological framework of respect for individual rights, requiring any measure taken to pass the test of proportionality.
