"In favour. Council Regulation (EC) No 1260/1999 identified the various forms of assistance that could be provided through Structural Fund contributions. Member States established during the 2000-2006 programming period these forms of assistance by setting up specific funds and through repayable assistance delivered via other instruments. On the contrary, Council Regulation (EC) No 1083/2006 does not provide a definition of assistance as either repayable or non-repayable. It contains provisions for ‘Financial Engineering Instruments’; however, these provision are rather narrow. Repayable assistance seems not to be covered by this regulation. Nonetheless, Member States continued to use repayable forms of assistance based on the positive experience of the past programming period. Even the Commission approved programming documents, including descriptions of these systems. The European Court of Auditors has identified the issue of repayable assistance in its audits of ERDF operations. It is therefore necessary to set out in Regulation (EC) No 1083/2006 that the Structural Funds may cofinance repayable assistance. The Commission proposal aims to provide clarity about the legality of an existing legal practice."@en1
