"One of the main reasons for the railway sector’s state of stagnation is the many discrepancies between current national rules. Regulations vary far too much to be beneficial to the railway sector. This problem is compounded by the flawed implementation of the first railway package by many Member States. Following Parliament’s resolution of 11 June 2010 on this topic, the Commission has taken 13 Member States to the Court of Justice of the European Union ‘for failing to implement correctly the first railway package’. The numerous procedures involved in identifying failure to meet obligations under EU legislation certainly demonstrate the need to clarify and improve legislation. Another reason for concern is Member States’ lack of investment in infrastructure, the quality of which determines to a large degree the sector’s competitiveness. Many Member States have neglected the funding of the railway sector, while giving maximum support to the road infrastructure. The recast should help achieve a European railway area. The current reform should go beyond the limits of nationally defined interests in the railway sector. It is time now to construct a proper European railway area where passengers and goods can cross borders effortlessly."@en1
