"The basis of this report is the draft Council decision concerning the accession of the European Union to the 1974 Athens Convention relating to the Carriage of Passengers and their Luggage by Sea. The primary aim of this convention is to ensure the safety of passenger ships and passenger rights. It was, however, considered that the convention regulated insufficiently a number of substantive issues, including the nature and extent of the carriers’ liability and minimum requirements on insurance. Some of these issues were overcome with a Protocol negotiated under the aegis of the International Maritime Organisation, which was adopted on 1 November 2002, amending the Athens Convention. However, the accession of the European Union and its Member States was not consensual and, following four years of negotiations, a complementary regulation was tabled on the liability of carriers of passengers by sea in the event of accidents, with a view to concluding the Protocol and incorporating most of the substantive provisions into EU law. It was adopted in 2009 and will apply by 2013. The aforementioned steps enabled accession to the convention. I voted for this report for these reasons."@en1
