"Madam President, Parliament is currently examining the proposal for a directive on the use of passenger name record data for preventing, detecting, investigating and prosecuting terrorist offences or serious crimes. After this has been adopted, bilateral agreements between the European Union and third countries on passenger name record data must be updated accordingly. The length of period for retaining data should be reduced considerably. I should mention that in the case of the Data Retention Directive relating to telephony operators, for the same purposes, the constitutional courts in Romania, Germany and the Czech Republic considered that these provisions violated citizens’ fundamental rights and declared the relevant transposing acts unconstitutional. We call for: 1. the analysis and transfer of PNR data to be used solely to prevent and detect terrorist offences and serious crimes, including for conducting investigations, and to prosecute them; 2. the data required to achieve the set objectives and collected regularly by airlines to be transferred solely using the ‘push’ method; and 3. PNR data to be transferred to third countries in accordance with European legislation governing the protection of personal data and only on the basis of bilateral agreements."@en1
