"The Services Directive was adopted in 2006 and it remains a vital tool for the establishment of a fully functioning single market in services. Member States have made a significant effort towards implementation. The mutual evaluation process is set out in Article 39 of the Services Directive. It is a tool used for the first time in the EU legal instrument. Its main goal was to assess the state of the internal market for services following implementation of the directive. The article remains vague, however, as to the precise objectives of mutual evaluation. This lack of precision resulted in different expectations and perceptions of process among stakeholders but also policy makers. The common confusion is also to associate mutual evaluation with the work on the implementation and the transposition of the Services Directive. When working on mutual evaluation, Members States have been divided into six clusters of five countries each. The overall assessment of mutual evaluation as a policy tool is positive. I take the view that the mutual evaluation process should continue to function in the form of cluster discussions. We must, however, try to increase the transparency of the process. A certain level of confidentiality is essential if we are to encourage discussions between Member State administrative bodies, and stakeholders should have access to regular reports."@en1
