"The Court of Justice of the European Union has ruled that the traditional designation clauses included in bilateral air services agreements concluded by Member States infringe EU law because they allow a third country to reject, withdraw or suspend the permissions or authorisations of an air carrier that has been designated by a Member State but that is not substantially owned and effectively controlled by that Member State or its nationals.
These clauses constitute obvious discrimination, violating Article 49 of the Treaty on the Functioning of the European Union, which guarantees that nationals of the Member States can exercise their freedom of establishment in a Member State and the same treatment in a host Member State as that given to nationals of that Member State. This new agreement that has been negotiated by the Commission, in addition to correcting a discriminatory situation, brings obvious benefits in that it replaces the provisions of the eight current bilateral agreements with a horizontal agreement that restores a solid legal basis for EU-Cape Verde relations."@en1
