"Madam President, I welcome the fact that we are bringing the application of this principle up for discussion again, especially in view of Protocol No 2 of the Lisbon Treaty. I welcome the fact that a control mechanism is being devised for compliance with Article 5 of the Treaty on the Functioning of the EU. The new text designates the assignment of powers at EU and national level, thereby clarifying the operation of the subsidiarity mechanism. In practical terms, the characteristics of each Member State need to be taken into account, as well as those of its sub-units, when applying it. I must highlight the limited control exerted by the Court of Justice of the European Union over the application of this principle. This court can only go ahead and revoke an act issued illegally, without verifying compliance with subsidiarity. In this context, exerting control at legislative level is the way to complement what the Court is doing."@en1
