"Madam President, I would like to comment briefly on the report on Serbia that was published today by the European Commission. The report ignores one of the most problematic aspects, namely, the property restitution act passed by Belgrade in September. The act, which is otherwise of particular importance, includes a provision on restitution, which appears to strengthen the principle of collective culpability and collective liability as opposed to individual liability. However, as we know, the cornerstone of the European justice system is individual liability. Unfortunately, this fact has apparently passed unnoticed by the Commission. According to the provisions, all persons who were part of the occupying forces stationed in Serbia during World War II, as well as their successors, are excluded from the scope of the act irrespective of whether any form of individual liability can be proven in their case or not.
As it is, almost the entirety of the Hungarian minority in Vojvodina, who had been drafted against their will and under coercion, have been excluded. This passage of the act sheds a negative light on Serbia and will definitely hinder its acquisition of candidate status, but, at the same time, it also calls into question the Commission’s attitude."@en1
