"When discussing the monitoring of the application of EU law, the first thing to note is the important role of the Commission as ‘guardian of the Treaties’. Potential problems and their possible solutions must be considered from this standpoint. As such, an active stance on the part of the Commission is key to avoiding failures to comply with EU law by the Member States. As far as cases of non-compliance are concerned, it is important to stress the need for proper regulation, so as to reinforce the procedural legitimacy of the Commission’s actions and safeguard the public’s expectations relating to the correct application of EU law. It is also worth stressing the need to link the EU institutions with the Member States and their courts, as well as the European public itself, which has at its disposal the possibility of directly petitioning Parliament. These are all methods worth considering so as to achieve better European integration."@en1
