"Mr President, the principle of subsidiarity may be enshrined in the Treaty of Lisbon, but it remains a theory. I would like to give just a few examples of this. According to the flexibility clause in Article 352 of the Treaty on the Functioning of the European Union, the EU can enact regulations without the agreement of the national parliaments, if this helps to achieve the goals of the Treaties. Hear, hear! The Treaty of Lisbon has introduced clauses based on the
principle, simplified procedures and more majority decisions in the Council in order to rush through certain matters. The so-called passerelle clause, Article 311, gives the EU the opportunity and the right to raise its own taxes.
What has happened to subsidiarity? We will only have better legislation when it is drawn up in the place where it belongs, in other words, in the institutions directly elected by the people, which are the European Parliament and, in particular, of course, the national parliaments."@en1
