"Export controls on dual-use items have been the subject of EU-level measures. Regulation (EC) No 428/2009 of 5 May 2009 is the main EU instrument for the control of exports, transfer, brokering and transit of dual-use products.
Making decisions to change or update their control lists is the responsibility of the international export control regimes, since the national parliaments, the European Parliament and the European Union are not involved in these decisions.
With the amendment of Annex I to this regulation, a list of common dual-use items and technology is included. This means that all the commitments previously made by EU Member States within the framework of international regimes are guaranteed to be applied in a uniform and coordinated way throughout the EU.
However, although we consider increased democratic controls and greater transparency to be necessary, we believe it should fall to each individual Member State to decide on their control lists, so we do not agree that it should be the dual-use coordination group, chaired by the Commission, that decides in which countries the sale of dual-use products is permitted, thereby withdrawing this competence from the Member States."@en1
