"Madam President, I would also like to acknowledge the work of our rapporteur, Mr Busuttil, and the proposal to amend the regulation establishing the European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union (Frontex). This regulation has been supported by the work of the Commission and the Polish Presidency right at a time when we are focused on an agency that is based in Warsaw itself, and which is vital for understanding the significance of an area of freedom, security and justice for a globally relevant Europe, now that we are experiencing so many events – particularly in the Mediterranean region – that highlight the importance not of strengthening internal borders but of jointly defending and managing our external border. This can be done by strengthening the operational dimension of Frontex, its material and human resources, and the mandate that the Member States should contribute by fulfilling the solidarity clause; above all, however, we must strengthen its humanitarian dimension, in order to know who is responsible for off-shore operations, and underline the importance of saving lives and of responsibility in the area of disembarkation and first aid given to those rescued.
This therefore sends out a positive message of commitment to the humanitarian dimension of Frontex and to the protection of vulnerable people and unaccompanied minors, and of respect for the rules of international humanitarian law, particularly the Geneva Convention and the principle of non-refoulement.
We therefore have an opportunity to highlight the external dimension of the European Union, its humanitarian nature, as well as its internal dimension, the mandate for solidarity, which is legally binding, positive law for all Member States based on Article 70 of the Treaty of Lisbon."@en1
