"I welcomed this document, because there was a lack of transparency in the process of drafting the Constitution. The new Constitution was drafted and adopted in a very tight timeframe, and consequently did not leave enough time for a comprehensive and fundamental debate on the draft. A successful and legitimate Constitution should be based on the broadest possible consensus. The Hungarian authorities are urged to address the issues and concerns raised by the Venice Commission and to implement its recommendations either via amendments to the Constitution, or when adopting future constitutional and ordinary laws. In the meantime there are calls for the European Commission to conduct a thorough examination and analysis of the new Constitution and constitutional laws, which will be adopted in future, in order to check whether they comply with the acquis communautaire, particularly the Charter of Fundamental Rights and the word and spirit of the Treaties. While the drafting and adoption of a new constitution falls within the remit of Member States’ competences, Member States, current and acceding, and the EU, have a duty to ensure that the contents and the processes are in conformity with EU values, the Charter of Fundamental Rights, the European Convention on Human Rights (ECHR), and that the word and the spirit of the adopted constitutions do not contradict these values and instruments. It should be noted that Hungary is a signatory of the ECHR, the International Covenant on Civil and Political Rights and other international legislation, under which it must respect and apply the principles of the separation of powers, checks and balances and the promotion of democracy and human rights."@en1
