"Seven years after the entry into force (on 1 January 2004) of the Council framework decision of 13 June 2002 on the European Arrest Warrant (EAW) and the surrender procedures between Member States, the Commission has published some statistical data collected in the Member States between 2005 and 2009. Before the introduction of the warrant, the average time taken to extradite a wanted person was one year, whereas in these four years in which the EAW has been applied, it has been shown that approximately 50% of wanted persons agreed to their surrender after about 15 days. It is essential to take stock of the implementation and operation of the EAW now that doubt is being cast on whether the Schengen Information System is working properly and whether it should be suspended. We should not forget that the effectiveness of the EAW in the fight against cross-border crime, organised crime and terrorism depends on the principle of mutual recognition between Member States, which is the basis for having a real European judicial area and also for the Schengen area to work properly. It would be a backward step to put this situation in jeopardy; instead, we should concentrate on improving the transposition of the framework decision, especially in terms of protecting fundamental rights."@en1
