"As yet, there is no European contract law, even though the option of such a law has been debated within European institutions for over 20 years. The Commission now intends to propose, by way of regulation, the introduction of an optional instrument, commonly referred to as the ‘28th law’, which could govern cross–border contracts.
Whilst the intention to simplify contract law and expand cross-border trade is commendable, I nonetheless have doubts about the relevance of this approach: indeed there is a high risk that national rules, which provide maximum protection for consumers, will be bypassed. For this reason, I have decided to abstain on this own–initiative report, pending the Commission’s proposal for a regulation on this matter."@en1
