"I do not support the proposal to create an entirely new legal instrument in the form of a European contract law. The creation of this instrument is the first step towards the creation of a pan-European civil code, which would gradually replace the contract law of the individual Member States. The proposed concept may talk about the voluntary application of this instrument, but nevertheless it is clear from many indications that volunteering is only a kind of precursor to a subsequent mandatory application in cross-border contractual relationships. If this instrument is created, we will be introducing a completely new type of supranational law, which will be on the boundary between EU law and international private and commercial law, not to mention the fact that the mandate for creating a European contract law for consumers and businesses does not have sufficient support in primary EU law. We should therefore stick to a standard instrument, for which there is sufficient legal support in primary law in the form of harmonisation."@en1
